Detroit Bankruptcy Lawyer Helping You Get A Fresh Financial Start

At the bankruptcy law firm of Charles J. Schneider, P.C., in Livonia, Michigan, we represent clients in Chapter 7 bankruptcy and Chapter 13 bankruptcy proceedings. We are certified by the American Board of Certification. Since our inception in 1977, we have handled over 6000 personal bankruptcy cases. Contact us for a free initial consultation.

If you are overwhelmed with credit card debt, car loans, have huge hospital bills, are laid off from your auto industry job, have had a wage earner death in the family, or have unemployed children back in the nest, we can help. If you also face foreclosure, repossessions, liens, garnishments, and aggressive collections procedures by bill collectors, creditors and collection agencies, we can help stop foreclosure and take away liens. A skilled bankruptcy lawyer can give you the debt legal advice protection you need to keep your property, and the breathing room you need to obtain consumer debt relief.

Chapter 7 Bankruptcy

A Chapter 7 bankruptcy is ideal for people whose debt is mainly unsecured debt. Most unsecured debts can be discharged through Chapter 7 bankruptcy, with the exception of some taxes, student loans and child support. If you are burdened with unsecured debt, such as credit cards, also known as consumer debt, a Chapter 7 bankruptcy will forgive, or cancel the bulk of those debts. If you have secured debts, such as mortgaged property and financed cars, you can continue to make the scheduled payments or return the property to the securing party. It may be possible to reduce the car payment.

Chapter 13 Bankruptcy

Chapter 13 is often referred to as a "wage earner" plan because you must be receiving an income to participate in a Chapter 13 bankruptcy plan. The income that you receive to fund the plan, however, is not limited to earned wages. Self-employment, disability payments, unemployment income or a spouse's income may fund the plan. In a Chapter 13 bankruptcy, rather than canceling your debts, you receive additional time to pay off your debts. At the law firm of Charles J. Schneider, we can help with minimizing payments to as much as 10% on the dollar, based on the equity of your home, to unsecured creditors, or reduce your car payment based on the value of your car. In most cases, your debts can be paid off during the established time with no interest. At the end of the plan, whatever debts you have remaining may be cancelled. A Chapter 13 plan is ideal for people with secured debt, such as mortgaged homes and financed cars, because Chapter 13 allows you to keep your property while making planned payments. Payments can be combined on your car and home to help reduce your overall monthly expenditure on each. As bankruptcy lawyers, we can help stop foreclosure and repossession, so that you can keep your home and your car.
